Our services include your use of the websites, mobile apps, and other services provided by DesiOut. You acknowledge that you have read, understood, and agree to be bound by the full terms of this agreement. If you do not agree to the entire agreement, you should not use our services. Age Limit and Lawful use

We only allow our services to those 18 years or above. By using the services, you confirm that: You are at least 18 years old and meet the minimum age requirement set by the laws of your country of residence to access and use the services.
You may not use our services to break any law, violate an individual's privacy, or infringe upon the intellectual property or any other proprietary rights of any person or entity.
 

Service-level agreement

We do make use of third-party services and service providers including but not limited to hosting support, content delivery network, domain registry, analytics, etc. We do try our best to make our services available and accessible all the time, but we do not guarantee an uptime of the Services. We are always improving our Services to provide you with the best experiences. We may add or remove features, or functionalities at any given time with or without prior notice to you. We reserve the right to modify or discontinue the Services (in whole or in part) at any time, with or without notice to you. You agree that we will not be liable to you or any third party for any modification or discontinuation of the Services. You must maintain the security of your Account all the time.   • You are responsible for ensuring that the information provided on your public profile is truthful, current, and not misleading. Impersonation of others, use of fake identities, or misrepresentation is strictly prohibited.
  • Don’t be involved in asking for votes or engaging in vote manipulation or any other political propaganda.
  • Fake Reviews are not permitted; personal experiences may be shared only in region-specific forums.
  • Don’t be involved in faking your IP addresses to evade punishment or avoid restrictions
  • Don't post any malicious software/scripts, viruses, or involve in hacking attempts.
  • Don't post gaslighting content, pure political arguments, negativity or toxic topics. To maintain a respectful and inclusive environment, we kindly ask that you avoid political discussions, including party debates or candidate-specific discussions. We encourage positive and constructive conversations. You're welcome to share how specific policies are affecting your situation, as long as the discussion remains respectful and focused on the issue, not political affiliations or individuals.
  • Your content posted may be indexed by search engines. Do not include any information you wish to keep private.
  • By choosing to participate on our platform, you consent to have your username, community preference (i.e. nationality, nation name, ethnicity, mother tongue or similars) and city name displayed to anyone using this platform. This helps foster a more connected and engaging experience while respecting your privacy.
  • Our services are intended to be a place for having a meaningful discussion that matters to you. We take no responsibility for any content contributed by you through our services. This includes but is not limited to content accuracy and truthfulness. We do not assume any liability for any content contributed by you. By submitting Content to the Services, you represent and agree that you have the right to submit anything you post/share, and that your user content does not violate the copyright, trade secret, trademark, or any other personal or proprietary right of any other party.   • Our platform allows our members to post third-party links/content. This may be posted by our users, advertisers, partners, affiliates, or similars. Third-party content is not under our control, and we are not responsible for any third-party Services. Your use of Third-Party Content is at your own risk and you should make any investigation you feel necessary before proceeding with any transaction in connection with such Third-Party Content. We also allow you to embed third-party content by simply posting the links. You agree to take full legal responsibility for any links you post. You must consult the terms and privacy policies of those other websites to understand your rights before posting to our Services.
  • At DesiOut we do offer Moderating experience to our selected users. You understand and agree that Moderating is an unofficial, unpaid, voluntary position. If you are those selected users with Moderating experience, you understand and agree that we reserve the right to revoke your moderating experience anytime with or without any advance notice. You agree that you will never misuse your moderation experience for any wrongdoings. You also agree that you are not, and may not represent that you are, authorized to act on behalf of DesiOut. You may not enter into any agreement with a third party on behalf of DesiOut anytime. You may not perform moderation actions in return for any form of compensation, consideration, gift, or favor from third parties.
 

AI Usage & Data Access Restrictions

Prohibition on AI and Machine Learning Use
    You may not use this website, its content, or any data obtained from it for the purposes of:
  • Training, fine-tuning, or evaluating any artificial intelligence or machine learning models
  • Building, enhancing, or validating datasets for AI systems
  • Developing or improving any automated decision-making systems
Prohibition on Automated Access and Scraping

To the maximum extent permitted by law, we and our affiliates and any third-party service providers disclaim any and all warranties, express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, or any other warranty, condition, guarantee or representation, whether oral or electronic. You are solely responsible for any damage to your device, loss of use, or loss of your user content. We do not guarantee that DesiOut will always work properly.
 

Limitation of liability

DesiOut will not be responsible for user-generated content. Users assume full responsibility for their posts and any legal consequences. DesiOut does not guarantee accuracy or reliability of any user-submitted content. DesiOut will not be liable for any special, consequential, indirect, incidental, punitive, reliance, or exemplary damages, whether in tort, contract, or any other legal theory, arising out of or in any way connected with this agreement or your use of or attempt to use DesiOut, including (but not limited to) damages for loss of profits, goodwill, use, or data. This limitation on liability shall not be affected even if we have been advised of the possibility of such damages. Some states do not allow for the exclusion of implied warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above exclusions may not apply to you. You may have other rights that vary from state to state.

You agree to release us, our affiliates, and third-party service providers, and each associated director, employee, agents, and officers, from claims, demands and damages (actual and consequential), of every kind and nature, known and unknown, disclosed or undisclosed, arising out of or in any way connected to your use of DesiOut.

Third party Logos, company names used on this platform (if any) are only for reference purposes and they may be respective owner's right or trademarks.

 

Governing law

We want you to enjoy DesiOut, so if you have an issue or dispute, you agree to raise it and try to resolve it with us informally. You can contact us with feedback and concerns via the Contact Us page.

The headings in this agreement are for convenience and do not control any of its provisions. Any claim or dispute between you and us arising out of or relating to this user agreement, in whole or in part, shall be governed by the laws of the State of Texas without respect to its conflict of law’s provisions. We agree and you agree to submit to the personal jurisdiction and venue of the state and federal court located in Dallas County, Texas.

 

Severability and enforcement

If any provision of this user agreement is held invalid or unenforceable, that provision will be modified to the extent necessary to render it enforceable without losing its intent. If no such modification is possible, that provision will be severed from the rest of this agreement.

If we do not enforce any right or provision in this user agreement, that is not to be deemed a waiver of our right to do so in the future.
